1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you and Aura ("we," "us," or "our"). By downloading, accessing, or using the Aura software application (the "App"), you agree to be bound by these Terms. If you do not agree, you must immediately cease using the App.

2. Nature of the Service

Aura is a self-custodial, non-custodial software interface that allows you to manage your digital assets on the Polygon network.

  • Self-Custody: We do not have custody, possession, or control of your digital assets at any time. You maintain full control over your private keys and assets.
  • No Financial Advice: The App is strictly a tool. We do not provide financial, investment, tax, or legal advice. Nothing in the App should be construed as a recommendation to buy, sell, or hold any asset.
  • No Account Recovery: Since we do not store your private keys or seed phrases, we cannot recover your funds if you lose your credentials. You are solely responsible for securing your wallet backup.

3. User Responsibilities

By using the App, you agree that:

  • You are of legal age to form a binding contract in your jurisdiction.
  • You will not use the App for any illegal or unauthorized purpose, including money laundering, terrorist financing, or sanctions evasion.
  • You are responsible for the security of your device and your private keys.
  • You understand the risks associated with cryptographic systems, including the risk of hacking, software bugs, and volatile asset prices.

4. Third-Party Services

The App may allow you to access third-party services, including fiat-to-crypto providers (e.g., MoonPay) and decentralized applications.

  • We do not control these third-party services and are not responsible for their content, policies, or practices.
  • Your use of third-party services is subject to their respective terms and conditions.
  • Any transactions involving fiat currency are processed by third-party providers, not by Aura. We do not process payments or handle fiat funds.

5. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, Aura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App.
  • Unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any bugs, viruses, or trojan horses transmitted to or through the App.
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content.
  • Your loss of private keys or seed phrases.

6. Termination

We reserve the right to modify, suspend, or discontinue the App at any time, with or without notice. We may also terminate your access to the App if you violate these Terms.

7. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any modifications constitutes your acceptance of the new Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Aura operates, without regard to its conflict of law provisions.
